ExactPour Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the ExactPour Service and is incorporated by reference into the Terms of Service (the Master Subscription Agreement). Violations of this AUP may result in content removal, throttling, suspension, or termination of your account as described in the Terms of Service. We may update this AUP from time to time; continued use after the effective date constitutes acceptance.

1. Lawful and Authorized Use

You must use the Service only for lawful business purposes and in full compliance with all applicable laws and regulations, including federal, state, and local alcohol beverage control (ABC) laws and the licensing, sale, advertising, tied-house, and record-keeping requirements they impose. You are solely responsible for obtaining and maintaining all licenses, permits, and authorizations required to operate your business and for ensuring that all data you submit to or generate through the Service (including inventory, sales, waste, and compliance records) is accurate and lawful.

ExactPour does not provide legal, regulatory, or compliance advice. You are responsible for reviewing and verifying all outputs, including AI-generated recommendations, before relying on them.

2. Prohibited Activities

You may not, and may not permit any Authorized User or third party to:

  • access or use the Service without authorization, or attempt to bypass authentication, access controls, tenant isolation (Row Level Security), usage quotas, or rate limits;
  • probe, scan, or test the vulnerability of the Service, or breach any security or authentication measure, except under a mutually authorized security-testing program;
  • upload, transmit, or introduce malware, viruses, or any code intended to interfere with, disrupt, or damage the integrity, performance, or security of the Service;
  • reverse engineer, decompile, disassemble, or attempt to derive source code, algorithms, or underlying ideas from the Service, except to the extent expressly permitted by applicable law;
  • use the Service (including any AI, forecasting, automation, or agentic features) to build or train a competing product or service. You may evaluate ExactPour against another product for your own buying decision;
  • resell, sublicense, rent, lease, or otherwise provide the Service (or access to it) to any third party except as expressly authorized in your Order or the Terms of Service;
  • use automated means (including scripts, bots, or agents) to scrape, extract, or harvest data from the Service beyond the documented APIs and applicable rate limits;
  • use any automation, scripting, browser automation, or agentic features to violate the terms of service, acceptable use policies, or robots.txt directives of any third-party website, API, or service, or to perform unauthorized actions on behalf of or against any third party;
  • infringe any intellectual property, privacy, publicity, or other rights, or upload, submit, or transmit any unlawful, defamatory, obscene, infringing, or harmful content;
  • submit, upload, or manipulate false, fraudulent, incomplete, or deliberately misleading inventory, sales, waste, recipe, or business data with the intent to evade taxes, licensing requirements, record-keeping obligations, or other regulatory requirements under alcohol beverage control or other applicable laws;
  • misuse AI-powered features, including by submitting malicious prompts, attempting prompt injection or jailbreaking, generating or processing unlawful or harmful content, or using AI outputs to create or distribute infringing or deceptive material;
  • use the Service or any integration (including Toast POS or barcode/AI providers) in a manner that violates the terms of service or acceptable use policy of that third-party service;
  • share, sell, or otherwise disclose your account credentials, or allow any unauthorized person or entity to access or use your account;
  • use the Service to harass, threaten, abuse, or harm any person or entity, or to send unsolicited bulk communications ("spam"); or
  • otherwise use the Service in any manner that violates applicable law or the rights of others, or that could expose ExactPour or other customers to legal liability or operational harm.

3. Fair Use, Quotas, and API Limits

Your plan includes defined usage quotas (including weekly scan quotas) and API rate limits. You must not use the Service in a manner that materially exceeds normal usage patterns for your plan tier or that degrades performance or availability for other customers. We may monitor usage, throttle excessive activity, require a plan upgrade, or suspend access for violations of this section.

4. Account and User Responsibility

You are responsible for all activity under your account and for ensuring that all Authorized Users comply with this AUP and the Terms of Service. You must maintain the confidentiality of credentials and promptly deactivate access for any user who leaves your organization or no longer requires access.

5. Enforcement and Consequences

We may investigate suspected violations of this AUP and cooperate with law enforcement or regulatory authorities as appropriate. We reserve the right to remove content, suspend or terminate accounts (in whole or in part), or take other remedial action, with or without prior notice, particularly where a violation poses an imminent security, legal, operational, or compliance risk. You remain liable for any fees owed through the date of suspension or termination.

6. Reporting Violations

If you become aware of any violation of this AUP or a security concern, please report it immediately to support@exactpour.com. We take reports seriously and will investigate promptly.
